Important: These Terms of Service contain an arbitration clause and class action waiver. Please read Section 15 carefully.
Welcome to Retidi! These Terms of Service ("Terms") govern your access to and use of the Retidi platform, website, and services. By using Retidi, you agree to these Terms.
1. About Retidi
Retidi is a technology platform that connects customers who need cleaning services with independent cleaning professionals ("Cleaners"). Retidi is not a cleaning company and does not employ cleaners. We are a marketplace that facilitates connections between users.
2. Eligibility
To use Retidi, you must:
- Be at least 18 years old
- Have the legal capacity to enter into a binding contract
- Provide accurate and complete information
- Not be prohibited from using our services under applicable law
- Not have been previously banned from the platform
3. Account Registration
3.1 Creating an Account
To book services or become a Cleaner, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
3.2 Account Termination
We reserve the right to suspend or terminate your account if you:
- Violate these Terms
- Provide false information
- Engage in fraudulent activity
- Abuse or harass other users
- Fail to pay for services
4. Services for Customers
4.1 Booking Services
When you book a cleaning service through Retidi:
- You enter into a direct contract with the Cleaner (not Retidi)
- Prices are displayed before booking confirmation
- Payment is processed immediately upon booking
- You must provide accurate property information
- You must provide safe and legal access to the property
4.2 Property Access
You are responsible for:
- Providing clear access instructions
- Ensuring the property is safe for the Cleaner
- Securing valuable items before service
- Notifying us of any hazards (pets, mold, etc.)
4.3 Cancellation Policy
- More than 48 hours before: 100% refund
- 24-48 hours before: 75% refund
- 2-24 hours before: 50% refund
- Less than 2 hours or no-show: No refund
4.4 Satisfaction Guarantee
If you're not satisfied with a cleaning:
- Contact us within 24 hours of service completion
- Provide specific details about the issue
- We'll arrange a re-clean or refund at our discretion
5. Services for Cleaners
5.1 Independent Contractor Status
Cleaners are independent contractors, not employees of Retidi. You:
- Set your own availability and service areas
- Accept or decline job offers
- Are responsible for your own taxes (1099 form provided)
- Provide your own equipment and supplies
- Maintain your own insurance
5.2 Approval Process
To become a Cleaner on Retidi, you must:
- Complete the application process
- Provide valid government-issued ID
- Pass a background check
- Provide proof of insurance (when required)
- Agree to maintain a 4.0+ star average rating
5.3 Service Standards
As a Cleaner, you agree to:
- Arrive on time for scheduled jobs
- Complete services to a professional standard
- Take before and after photos
- Communicate professionally with customers
- Respect customer property and privacy
- Report any issues or damages immediately
5.4 Payment Terms
- Platform fee: 18% of booking amount (subject to change)
- Payment processing: Stripe fee (~2.9% + $0.30)
- Payout timing: 2-3 business days after job completion
- Payouts via Stripe Connect to your bank account
6. Pricing and Payments
6.1 Service Fees
- All prices are displayed in USD
- Final price shown before booking confirmation
- Prices include platform fee but not tips
- We reserve the right to change pricing at any time
6.2 Payment Processing
- All payments processed through Stripe
- We do not store credit card information
- Payments captured immediately upon booking
- Refunds processed within 5-10 business days
6.3 Tips
Customers may add tips after service completion. Tips go 100% to the Cleaner (minus payment processing fees).
7. Reviews and Ratings
- Both customers and cleaners may leave reviews
- Reviews must be honest and based on actual experience
- We prohibit fake, misleading, or retaliatory reviews
- We may remove reviews that violate our policies
- Cleaners with consistently low ratings may be removed
8. Prohibited Conduct
You may not:
- Use the platform for illegal purposes
- Provide false or misleading information
- Harass, abuse, or discriminate against other users
- Attempt to circumvent the platform to avoid fees
- Share contact information to book directly (fee avoidance)
- Use bots, scrapers, or automated tools
- Copy, modify, or reverse engineer our platform
- Upload viruses or malicious code
9. Liability and Disclaimers
9.1 Platform Disclaimer
Retidi is a technology platform only. We do not:
- Employ or supervise cleaners
- Guarantee the quality of services
- Control how cleaners perform their work
- Assume liability for cleaner actions
9.2 Service "AS IS"
Our platform is provided "AS IS" without warranties of any kind. We do not guarantee that:
- The platform will be error-free or uninterrupted
- Cleaners will be available when you need them
- Services will meet your expectations
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Retidi is not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for the service in question
- We are not liable for cleaner actions, property damage, or personal injury
- We are not liable for third-party actions or services
10. Indemnification
You agree to indemnify and hold harmless Retidi and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from:
- Your use of the platform
- Your violation of these Terms
- Your violation of any rights of another person
- Services performed by cleaners (for customers)
- Your provision of services (for cleaners)
11. Insurance
11.1 Platform Insurance
Retidi maintains general liability insurance covering certain property damage and injuries occurring during services. This insurance is secondary to any insurance maintained by Cleaners.
11.2 Cleaner Insurance
Cleaners are encouraged to maintain their own liability insurance. Some jobs may require proof of insurance.
12. Privacy
Your use of Retidi is also governed by our Privacy Policy. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.
13. Intellectual Property
All content on the Retidi platform, including text, graphics, logos, and software, is owned by Retidi or its licensors and protected by copyright and trademark laws. You may not:
- Copy, modify, or distribute our content without permission
- Use our trademarks or logos without authorization
- Create derivative works based on our platform
14. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes must be resolved in Delaware.
15. Dispute Resolution and Arbitration
IMPORTANT: PLEASE READ THIS SECTION CAREFULLY.
15.1 Informal Resolution
Before filing a claim, you agree to contact us at legal@retidi.com to attempt to resolve the dispute informally.
15.2 Binding Arbitration
If we cannot resolve a dispute informally, you agree that any disputes will be resolved through binding arbitration rather than in court, except that:
- You may assert claims in small claims court if they qualify
- Either party may seek injunctive relief in court for intellectual property disputes
15.3 Class Action Waiver
YOU AND RETIDI AGREE THAT DISPUTES WILL BE RESOLVED INDIVIDUALLY, NOT AS A CLASS ACTION, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
15.4 Arbitration Rules
- Arbitration conducted by the American Arbitration Association (AAA)
- Arbitration held in New Castle County, Delaware
- Each party responsible for their own attorney's fees
- Arbitrator's decision is final and binding
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the updated Terms on our website
- Updating the "Last Updated" date
- Sending email notification for significant changes
Your continued use of Retidi after changes are posted constitutes acceptance of the new Terms.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Retidi regarding your use of the platform.
